Terms of service

These terms apply to website design and development work carried out by KustomSite. The accepted proposal for your project sits above these terms: where the two differ, the proposal governs.

Scope
Your accepted proposal defines what is included, what is excluded, the number of pages, the number of revision rounds and the expected timeline. Work outside that scope is quoted separately and only begins once you have agreed it in writing. An accepted proposal cannot be altered after acceptance; a change produces a new version which you accept in the same way.

Payment
A deposit, stated as a percentage in your proposal, is due before work begins. The balance is due before launch. Launch is conditional on the balance being paid. Prices are in USD and exclude any taxes that apply to you.

Your responsibilities
You agree to provide the content, images, logo and information requested during onboarding, and to confirm that you have the right to use everything you supply. Delays in providing these move the timeline, which is why the process states what is needed at each step. Feedback is given in consolidated rounds as set out in your proposal.

Revisions
Your proposal states how many revision rounds are included. A round means one consolidated set of feedback and the changes made in response. Further rounds, and changes that alter the agreed scope, are charged at the rate in your proposal.

Ownership
On final payment, you own the website: the design, the content and the code written specifically for your project, along with your domain. Third-party components remain under their own licences, which permit your use of them as part of your site. We retain the right to describe the work and show it as an example, unless you ask us in writing not to.

Hosting and care plans
Care plans are optional, billed monthly in advance, and can be cancelled at any time effective at the end of the current period. They are not required for you to keep your website. If a plan lapses, your site continues to exist but stops receiving updates, backups and monitoring, and we will help you move it wherever you want it hosted.

What we do not promise
We do not guarantee any search engine ranking, volume of traffic, number of enquiries or level of revenue. These depend on your market, your competition and factors outside anyone’s control. We do commit to building your site on a sound technical foundation, which is what we are able to control.

Warranty and corrections
For 30 days after launch we will correct, at no charge, any defect in the work we delivered. This does not cover changes of mind, new requirements, or problems caused by changes made by you or a third party after launch.

Limitation of liability
To the extent the law allows, our total liability arising out of your project is limited to the amount you have paid us for it, and we are not liable for indirect or consequential loss including lost profits or lost business. Nothing in these terms limits liability that cannot lawfully be limited.

Cancellation
You can stop a project at any time. Deposits cover work already scheduled and performed and are non-refundable once work has begun. Any amount paid beyond the value of work completed is refunded. You receive the work produced to that point.
